TRAUMA HEALING ACCELERATED TERMS AND CONDITIONS

You are purchasing a 1:1 parts-focussed coaching session from an affiliate coach. This affiliate coach receives referrals from Trauma Healing Accelerated (THA) and under no circumstances is an employee, independent contractor, or representative of THA. In this agreement, any uses of second person pronouns such as “you” or “your” refer to you as the client who signed below. All uses of first person pronouns such as “We” or “us” refer to Trauma Healing Accelerated, LLC, which is also referred to as "THA” in this agreement. This Agreement is between you (the client who signed below) and Trauma Healing Accelerated.

Terms and Conditions. This agreement releases THA from all liability relating to any  1:1 parts-focussed sessions or practices performed by affiliate coaches receiving referrals from THA. Affiliate coaches work independently from THA Services. As part of our Referral Program, THA offers contact and booking information for affiliate coaches with the desire to further assist our clients. These 1:1 parts-focussed sessions may also be purchased in some of our package deals to increase the affordability to clients. THA is not providing the 1:1 parts-focussed session services.

Refunds. If payment for a 1:1 parts-focussed session is collected by THA, refunds will be issued for appointments canceled 48 hours in advance. No shows or appointments canceled without 48 hour notice will NOT be refunded. Other refund policies are determined by the individual affiliate  coaches. To request a refund, contact your affiliate coaches.

Scope of Services. You understand that the affiliate coach is an affiliate providing 1:1 parts-focussed session services independently of THA. THA is not liable for the affiliate coach’s negligent, intentional or malicious actions or omissions. Neither Dr. Aimie Apigian, THA representatives, or your affiliate coach provide medical treatment, psychological treatment, or psychiatric services. Neither this agreement nor the provision of services under it establish a 

physician-patient or therapist-client relationship with us or your affiliate coach. While Aimie Apigian and your affiliate coaches might hold professional licenses, you understand that the services provided to you are not licensed by any state. You will not receive a diagnosis or treatment plan based on that diagnosis. These services are not reimbursable by insurance. 

Confidentiality. You acknowledge that HIPAA does not apply to any information you share with us or the affiliate coach, and that you understand there is no doctor-patient or therapist-client privilege between you, THA, or the affiliate coach. We will keep private any nonpublic information you share with us during or in connection with your  1:1 parts-focussed session(s) (“Confidential Information”) and will not share such information to any third party unless compelled to by law or otherwise provided in this Agreement. If a third party seeks to compel us to disclose your Confidential Information, we will inform you of this fact within a reasonable time. If you ask us to resist the third party’s efforts to compel disclosure, you must pay all costs we incur to resist such disclosure. We may share Confidential Information with any of the following persons, and any of the following persons may share Confidential Information with us or any other of the following persons: (a) your affiliate coach you have a 1:1 parts-focussed session with under this Agreement. Before we share Confidential information with any such person, we must require that person to sign an agreement requiring that person to keep the Confidential Information confidential under the same or similar terms as required under this Agreement.

Results may vary. In any 1:1 parts-focussed work session relationship, results can and do vary. Therefore, we make no guarantee that you will achieve a particular result. Further, we do not make any representation or warranty, express or implied, regarding our affiliate 1:1 parts-focussed session services or the results you may achieve from participating in the 1:1 parts-focussed sessions, and expressly disclaim any such warranties, including the warranty of merchantability and fitness for a particular purpose. The testimonials and examples used are not intended to represent or guarantee that anyone will achieve the same or similar results. 

Arbitration and Legal Remedies. If there ever arises a dispute between you and us with respect to THA’s liability in providing 1:1 parts-focussed session referrals, provided pursuant to this agreement or otherwise pertaining to the relationship between the parties, the parties agree to submit to binding arbitration before the American Arbitration Association (Commercial Arbitration and Mediation Center for the Americas Mediation and Arbitration Rules). Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Such arbitration shall be conducted by a single arbitrator in the city of Box Elder, South Dakota. The sole remedy that can be awarded to you if an award is granted in arbitration is refund of all fees paid to us. Without limiting the generality of the foregoing, no award of consequential or other damages, unless specifically set forth herein, may be granted to you. The laws of the State of South Dakota, except its choice of law principles, will govern this agreement and any dispute arising out of this agreement or the coaching session. If any provision of this agreement is deemed unenforceable, the remaining portions of the agreement shall be severed and remain in full force.

• You agree to indemnify and hold harmless Trauma Healing Accelerated against all claims, losses, expenses, and liabilities of every kind including reasonable attorney’s fees arising from sessions or your relationship with any of our affiliate coaches. You expressly release the Trauma Healing Accelerated Host from all claims arising out of the use of the materials provided and for the use of the recordings for training purposes.

• You agree to release THA from any liability for any coaching services provided by affiliate health coaches. Further, I acknowledge that THA or affiliate coaches are NOT operating as medical providers or mental health providers and any medical/mental health questions or concerns in relation to 1:1 parts-focussed sessions or recommendations need to be addressed with my regular physician. For any emergencies, you should contact 911.

In this agreement, any uses of second person pronouns such as “you” or “your” refer to you as the client who signed below. All uses of first person pronouns such as “We” or “us” refer to Kimberly Erickson, which is also referred to as "affiliate coach” in this agreement. This Agreement is between you (the client who signed below) and Kimberly Erickson.

You understand that the affiliate coach is providing 1:1 parts-focussed session services and the affiliate coach does not provide medical treatment, psychological treatment, or psychiatric services. You should always discuss any dietary changes or dietary supplements with your medical provider and you should not discontinue any prescription medications without consulting your medical provider first. You understand that the services provided to you are not licensed by any state. You will not receive a diagnosis or treatment plan based on that diagnosis. These services are not reimbursable by insurance. 

Confidentiality. You acknowledge that HIPAA does not apply to any information you share with the affiliate coach, and that you understand there is no doctor-patient or therapist-client privilege between you and the affiliate coach. You acknowledge that your affiliate coach may share information with Trauma Healing Accelerated and Dr. Aimie Apigian as part of the 1:1 parts-focussed session and as outlined in the agreement between you and Trauma Healing Accelerated.

Results may vary. In any 1:1 parts-focussed session relationship, results can and do vary. Therefore, we make no guarantee that you will achieve a particular result, even if you notify your affiliate coach of your desire to achieve that result. Further, we do not make any representation or warranty, express or implied, regarding our 1:1 parts-focussed session services or the results you may achieve from participating in the 1:1 parts-focussed sessions, and expressly disclaim any such warranties, including the warranty of merchantability and fitness for a particular purpose. The testimonials and examples used are not intended to represent or guarantee that anyone will achieve the same or similar results. You acknowledge that your success depends on many factors, including but not limited to, your background, dedication, starting point in your health, desire and motivation.

If any provision of this agreement is deemed unenforceable, the remaining portions of the agreement shall be severed and remain in full force.

You expressly release Trauma Healing Accelerated from all claims arising out of the use of the materials provided during a 1:1 parts-focussed session.

• You agree to release Kimberly Erickson from any liability for any 1:1 parts-focussed session services provided. Further, I acknowledge that the affiliate coach is NOT operating as medical providers and any medical questions or concerns in relation to 1:1 parts-focussed sessions or recommendations need to be addressed with my regular physician.
